सर्वोच्चको फैसलाले भविष्यमा कुनै पनि प्रधानमन्त्रीले संसद विघटन गर्न सक्दैन भन्ने स्थापित गरेको जानकारहरू बताउँछन् ।
प्रस्तुत छ, अदालतको फैसलाबारे सर्वोच्च अदालतका पूर्वन्यायाधीश गिरीशचन्द्र लाल र विशेष अदालत, बबरमहलका पूर्वअध्यक्ष गौरीबहादुर कार्कीको धारणा :

पूर्वन्यायाधीश, सर्वोच्च अदालत
सर्वोच्च अदालतको फैसलापछि प्रतिनिधिसभा ५ पुस भन्दा पहिलाकै अवस्थामा पुगेको छ । त्यतिबेला १७ पुसभित्र संसद अधिवेशन बोलाउनु पर्ने थियो । त्यही दिन हिसाब गरेर अदालतले १३ दिनभित्र बैठक बोलाउनु भनेको देखिन्छ । प्रधानमन्त्रीले गर्नुभएको सिफारिस र राष्ट्रपतिले जारी गर्नुभएको विज्ञप्ति दुवैलाई अदालतले बदर गरेको छ ।
संविधानको धारा ७६ को व्याख्या गर्दै अदालतले सरकार बन्ने अवस्था रहेसम्म संसद विघटन गर्न पाइँदैन भनेको छ । २०४७ सालको संविधानको धारा ५३ को ४ मा भएको विघटनको अधिकार अहिलेको संविधानले प्रधानमन्त्रीलाई दिएको छैन भन्ने व्याख्या हो । संसदीय व्यवस्थमा प्रधानमन्त्रीलाई विघटनको अधिकार हुने भए पनि वर्तमान संविधानमा त्यो अधिकार दिइएको छैन भन्ने अदालतको व्याख्या हो ।
अदालतको व्याख्या एकदमै राम्रो छ । व्यक्तिगत रुपमा पनि म खुसी छु । मलाई लाग्छ, अदालतको यो फैसलाले न्यायालयप्रतिको जनविश्वास अझै बढाउँछ ।

प्रधानमन्त्रीले संवैधाधनिक अधिकार भन्दा बाहिर गएर गरेको निर्णय अदालतले सच्याएको हो । सरकार बन्ने अवस्था हुँदासम्म संसद विघटन गर्ने अधिकार प्रधानमन्त्रीमा छैन भन्ने अदालतको स्पष्ट सन्देश हो । संविधानलाई ट्रयाक भन्दा बाहिर लान खोजिएको थियो । अदालतले संसदीय अधिकार संविधान भित्र रहन्छ भनेको हो ।
रात रहे अग्राख पलाउँछ भनेर होला अदालतले छिट्टै फैसला गर्यो । भविष्यमा कुनै पनि प्रधानमन्त्रीले विघटन गर्न सक्दैन । जनताले पाँच वर्षका लागि निर्वाचित गरेर पठाएको संसद बीचैमा मार्न पाँइदैन भन्ने अदालतको सन्देश रह्यो । फैसलाको व्याख्या पनि एकदमै राम्रो आयो । संवैधानिक इजलासका पाँचै जनाले सर्वसम्मत् फैसला गर्नु पनि आफैमा सकारात्मक छ ।
