शुक्रबार साँझ हामी कलकत्ता शहरको उत्तरमा पर्ने शोदपुरमा पुग्दा उनी फोनमा बोलिरहेका थिए। बंगालीमा उनले बोलेका शब्द नबुझे पनि अनुहारको भाव सजिलै बुझिन्थ्यो- उनको अनुहारमा खुसी दौडिरहेको थियो।
ह्याम रेडियो अपरेटरहरूको संस्था पश्चिम बंगाल रेडियो क्लबका सचिव अम्बरिश नाग विश्वासको अनुहारमा त्यो खुसी इलामका दुर्गाप्रसाद तिम्सिना ४० वर्षपछि भारतीय जेलबाट छुट्न लागेकोमा छाएको थियो। किनकि, उनीहरूकै प्रयास र लडाइँले दुर्गाप्रसादले खुला आकाश देख्न पाउने भएका थिए।
विश्वाससँग त्यतिबेला फोनमा कुरा गरिरहेका थिए, सातखण्ड साहेबनगरका राधेश्याम दास। राधेश्याम हिन्दी र अंग्रेजी बोल्न नसक्ने भएकाले हामीले उनीसँग कुरा गर्न सकेनौं। तर कलकत्तास्थित दमदम सेन्ट्रल जेलमा हुँदा उनले गरेको कुराकानीले दुर्गाप्रसादको जिन्दगी बदलिदियो।
राधेश्यामलाई नन्दीग्राममा भएको जग्गा अधिग्रहणविरूद्ध आन्दोलन गर्दा राज्यद्रोहको मु्द्दा लागेछ र जेल परेछन्। दमदम सेन्ट्रल जेलमा उनले दुर्गाप्रसादलाई देखे। १० वर्षअघि पनि अर्को मुद्दामा त्यही जेलमा बसेका राधेश्याम दुर्गाप्रसादलाई फेरि भेट्दा आश्चार्यमा परे। उनले दुर्गाप्रसादसँग कुरा गरे। ४० वर्षदेखि बिना कुनै अदालती सुनुवाइ जेलमा परेका दुर्गाप्रसादको नियति र उनीमाथि भएको अन्यायले राधेश्यामको मन छोयो।
गत वर्ष जेलबाट रिहा भएपछि उनले अम्बरिशलाई फोन गरेछन्। उनीहरू दुई जनाको पहिला चिनजान थिएन। विविध सामाजिक काम गर्दै आएका अम्बरिशको नम्बर उनले इन्टरनेटबाट फेला पारेछन्।
‘उहाँले मलाई दीपकजी (भारतीय कागजातमा दुर्गाप्रसादको नाम दीपक जैसी छ) ४० वर्षदेखि जेलमा हुनुहुन्छ। तपाईंहरू त सामाजिक काम गर्नुहुन्छ, त्यो मान्छेलाई छुटाउनु पर्यो भन्नुभयो,’ अम्बरिशले सेतोपाटीसँग भने,’सुरूमा त मैले पत्याइनँ। त्यस्तो पनि हुन्छ र भनें। तर उहाँले साँच्चै हो नपत्याए जेलमा सोध्नुहोला भन्नुभयो।’
राधेश्यामले दुर्गाप्रसादलाई जेलको कति नम्बर सेलमा राखिएको छ भन्ने पनि बताइदिए।
त्यसपछि अम्बरिशले जेलमा काम गर्ने साथीहरूलाई दुर्गाप्रसादबारे बुझ्न लगाए। उनका साथीले भने- हो, एक जना नेपाली जेल परेको ४० वर्ष भइसक्यो। ऊ यहीँ छ।
‘त्यसपछि मैले जेलका प्रहरी प्रमुखलाई फोन गरें र दीपकजीका बारे भनें। सुरूमा त उहाँले पनि पत्याउनु भएन तर म बुझ्छु भन्नुभयो,’ अम्बरिशले भने, ‘तपाईंले भनेको मान्छे जेलमा रैछ भनेर १० मिनेटमा उहाँले कल ब्याक गर्नुभयो।’
दुर्गाप्रसाद जेलमा छन् भन्ने त उनीहरूले थाहा पाए तर उनी कस्ता छन्? नेपालको कुन ठाउँमा उनका परिवार छ भन्ने पत्ता लगाउन सकेनन्।
‘हामीले जेलरसँग दीपकलाई भेट्न दिनुस् भनेर इमेल पठायौं। तर स्वीकृति मिलेन,’ अम्बरिशले भने,’उहाँहरूले आफन्त वा उच्च अदालतका वकिललाई मात्र भेट्न दिने भन्नुभयो।’
पश्चिम बंगाल रेडियो क्लबका उपाध्यक्ष हिरक सिन्हा कलकत्ता उच्च अदालतका वकिल थिए। उनले वकालती थालेको १५ वर्षजति भइसक्यो। वकिलको नाताले उनलाई जेलभित्र गएर दुर्गाप्रसादलाई भेट्न दिइयो।
दीपकलाई भेट्न जानुअघि सिन्हाले एक-दुइटा नेपाली वाक्य सिके। यत्रो वर्षसम्म जेलमा बसेका मान्छेलाई नेपालीमै बोले केही आश जाग्ला कि भनेर उनीहरूको यो तरिका अपनाएका थिए।
‘हामीलाई उहाँको ठेगाना जसरी पनि पत्ता लगाउनु थियो। सिन्हाजी भित्र गएर नमस्कार गर्नुभयो। बिस्तारै दाजु राम्रो छ, घर कहाँ हो? भनेर सोध्नुभयो,’ अम्बरिशले भने, ‘दीपकजीलाई लेख्न एउटा डायरी र पेन पनि दिनुभयो। हामी तपाईंलाई यहाँबाट छुटाउँछौं भन्नुभयो।’
त्यही डायरीमा दुर्गाप्रसादले आफ्नो नाम बुवा आमाको नाम लेखे।
सिन्हाले उनलाई एउटा कागजमा पनि हस्ताक्षर गर्न लगाए। त्यो कागजमा उनले आफ्नातर्फबाट मुद्दा लड्न वकालतनामा दिएको व्यहोरा थियो।
त्यसपछि उनीहरू कलकत्तास्थिन नेपाली महावाणिज्यदूत ईश्वरराज पौडेललाई भेट्न गए।
‘ईश्वर सरलाई सबै बतायौं। उहाँले भारतका कुनै पनि निकायले यो केसबारे महावाणिज्यदूतावासलाई जानकारी नै नदिएको बताउनुभयो,’ अम्बरिशले भने,’जे भयो भइहाल्यो। अब ठेगाना पत्ता लगाउने भनेर हामी छुट्टियौं।’
दिन हुँदै हप्ता बिते तर दुर्गाप्रसादको ठेगाना पत्ता लागेन।
त्यसपछि अम्बरिशले ह्याम रेडियोको सहारा लिए। ह्याम रेडियो विभिन्न रूची भएका मानिसहरूले सरकारबाट लाइसेन्स लिएर घरमा राख्ने रेडियो हो। यो रेडियोबाट आफ्नो रूची मिल्ने संसारभरका ह्याम रेडियो अपरेटरसँग कुरा गर्न सकिन्छ।
नेपालमा पनि केही ह्याम रेडियो प्रयोगकर्ता छन्। नेपाली ह्याम रेडियो अपरेटरको कोड ९एन१ हो। यही कोडमा अम्बरिशले दुर्गाप्रसादबारे जानकारी दिए।
सर्वोच्च अदालतका बरिष्ठ अधिवक्ता सतिशकृष्ण खरेल नेपालका पहिलो ह्याम रेडियो अपरेटर हुन्। खबर पाउनासाथ उनी दुर्गाप्रसादको ठेगाना पत्ता लगाउन थालिहाले।
‘अरूले पनि रेस्पोन्स गर्नुभएको थियो। तर सतिशसाबले सबैभन्दा पहिला दीपकजीको ठेगाना पत्ता लगाउनुभयो,’ अम्बरिशले भने,’त्यसपछि ह्याम रेडियोका स्थानीय साथीहरू दीपकको घरमा जानुभयो। उहाँकी आमा अझै हुनुहुन्छ भन्ने थाहा पाएपछि त हामी निकै खुसी भयौं।’
दुर्गाप्रसादकी आमा धनमाया तिम्सिना अहिले ८६ वर्षकी भइन्। दुर्गाप्रसादले घर छोडेरै गएको वर्ष उनको दाँया हात कुहिनामुनि काटिएको थियो।
घरमा आएका नयाँ मान्छेले चार दशकअघि हराएको छोराबारे सोध्दा धनमायाले ‘ऊ त यहीँ छ’ भनेर मुटुमा हात राखिछन्।
दुर्गाप्रसाद बाँचेकै छन् भन्ने सुनेर उनको अनुहार धपक्कै बलेछ। ह्याम रेडियोकर्मीले उनी हाँसेको फोटो कलकत्ता पठाए।
‘हामीले जेलमा त्यो फोटो दीपकजीलाई देखाउन भनेका थियौं तर प्रहरीले दिएन,’ अम्बरिशले भने।
प्रहरीको बुझाइमा दुर्गाप्रसाद निकै असल छन्। उनी आफ्नो भाग खाना पनि अरूलाई दिइदिन्थे। शान्तसँग बस्थे।
‘यतिका वर्षपछि आमाको फोटो देख्दा उनमा रिस बढेर हिंस्रक हुन सक्छन् भनेर प्रहरीले देखाउन दिएन,’ अम्बरिशले भने,’त्यसपछि हामी यी आमा-छोराको प्रत्यक्ष भेटघाट गराउनतिर लाग्यौं।’
हिरक सिन्हालगायत वकिलको टोली आफ्नै खर्चमा दार्जिलिङ गयो। त्यहाँ गएर सन् १९८०को वर्षमा दर्ता भएका मुद्दाहरूको लिस्ट माग्यो। कर्मचारीहरूले ४० वर्षअघिको मुद्दाको ढड्डा पल्टाउन आनाकानी गरे। उनीहरूले तिनलाई ‘चिया-पानी’ को व्यवस्था गरे। फाइल भेटियो।
फाइलमा हत्या आरोपमा दीपक जैसीविरूद्ध मुद्दा परेको देखियो तर उनलाई कहिल्यै अदालतमा उपस्थित गराइएको पाइएन। त्यहीबेलादेखि न्यायाधीशले दुर्गाप्रसादको मानसिक अवस्थाबारे प्रहरीसँग रिपोर्ट मागेका रहेछन् तर प्रहरीले बुझाएनछ।
सिन्हाहरूले फेरि त्यही मुद्दा ब्युँताए। न्यायाधीशले प्रहरीलाई उनको मानसिक अवस्थाको रिपोर्ट मागे। बेलाबेलामा मिति तोके। प्रहरीले रिपोर्ट दिन सकेन।
‘प्रहरीको यस्तो हेलचक्र्याइँबारे आनन्द बजार पत्रिकामा समाचार आयो। त्यसले अदालत प्रशासनमा हलचल ल्यायो,’ अम्बरिशले भने,’कलकत्ता उच्च अदालतका मुख्य न्यायाधीश आफैंले यो के भएको हो भनेर बुझ्न लगाउनुभयो। मुद्दा हाल्न लगाउनुभयो।’
त्यसपछि धेरै मानिसले अम्बरिशलाई ‘हामीले के सहयोग गर्नुपर्छ भन्नुस्’ भने। उनले सबैलाई भने- हामीलाई एउटी बूढी आमासँग उनका छोरालाई भेटाउनु छ। त्योभन्दा अरू केही सहयोग चाहिँदैन।
उच्च अदालतबाट ठूल्ठूला वकिलहरूले पनि यो मु्द्दा सित्तैमा लड्छु भनेको अम्बरिश बताउँछन्।
उच्च अदालतमा मुद्दा चल्यो। कलकत्तास्थित महावाणिज्यदूतावासबाट हिरक सिन्हा र प्रदीप मण्डलले बहस गर्ने भए। दुर्गाप्रसादको परिवारका तर्फबाट मलाई भट्टाचार्य र सुब्रज्योति घोष लड्ने भए।
यो मुद्दालाई कलकत्ता उच्च अदालतका मुख्य न्यायाधीश मुख्य न्यायाधीश थोट्टाथिल बि नायर राधाकृष्णनले आफ्नै बेञ्चमा राखे। बेञ्चमा अर्का न्यायाधीश अनिरूद्ध रोय थिए। सुनुवाइ भयो।
गत बुधबार अदालतले दुर्गाप्रसादलाई परिवारको जिम्मा लगाइदिन आदेश दियो।
त्यही आदेशबमोजिम उनलाई लिन भाइ (काकाका छोरा) प्रकाशचन्द्र तिम्सिना शुक्रबार कलकत्ता पुगे।
दिउँसो उनले दाजुलाई नेपाल लैजाने र ६-६ महिनामा उनको स्वास्थ्य अवस्थाबारे अदालतलाई जानकारी दिने सम्झौतामा हस्ताक्षर गरे।
उक्त सम्झौता अदालतबाट जेल पठाएपछि यी चारै जना वकिलहरू प्रफुल्लित थिए।
‘म र मेरा साथीले यो मुद्दा पैसा कमाउनभन्दा पनि मानवियताका लागि लडेका थियौं,’ उच्च अदालत परिसरमा सिन्हाले सेतोपाटीसँग भने,’अब उनी रिहा हुने भए। एक गरिब व्यक्तिले यतिका वर्षपछि आफ्नी आमालाई भेट्न पाउने भयो। बहुत आनन्द लागिरहेको छ।’
अर्का वकिल मलाई भट्टाचार्यले यो मुद्दा आफूहरूको करियरकै विशेष हुने बताए। दुर्गाप्रसाद जसरी नै बिना कुनै सुनुवाइ ३८ वर्षसम्म जेल परेका एक जनाको मुद्दामा भारतको सर्वोच्च अदालतले २००७ मा पनि यस्तै आदेश दिएको थियो।
‘मुद्दा त अरू पनि लड्यौं तर यो मुद्दा भारतकै न्याय प्रणालीमा विशेष हो। हाम्रा लागि पनि यो विशेष हुनेछ, किनकी यसमा मानवीयता मिसिएको छ,’ भट्टाचार्यले भने।
भर्खरै करियर सुरू गरेका दुई जना अरू वकिलले आफ्ना सिनियरहरूको भनाइमा सहमति जनाउँदै टाउको हल्लाए।
अन्तिम फैसला आउन बाँकी रहेकाले दुर्गाप्रसादको बाँकी जीवनलाई सहज बनाउन पनि अदालत राम्रो फैसला दिने उनीहरूको विश्वास छ।
‘अदालतको आदेशपछि तपाईंलाई कस्तो लाग्यो त?’ प्रश्न सुनेर अम्बरिश भक्कानिए। २०७२ सालको भूकम्पका बेला ह्याम रेडियो बोकेर काठमाडौं, गोरखा पुगेका उनले नेपालसँग आफ्नो भावना जोडिएको बताए।
‘हामीले एउटा लडाइँ जित्यौं। दीपकजी र उहाँकी आमा यतिका वर्षपछि एक-अर्कालाई देख्न पाउनु हुने भएको छ,’ अम्बरिशले भने, ‘भारतीय प्रशासनको लापरबाहीले एक जना मान्छेको जीवनै बर्बाद बनाइदियो। एक भारतीय हुनुका नाताले मेरो अहिलेको खुसीमा ग्लानी मिसिएको छ।’
