काठमाडौँ– निर्वाचन आयोगले सरकारी तलब खाने कुनै पनि कर्मचारीले कुनै पनि राजनीतिक दलको समितिमा बस्न नमिल्ने निर्णय गरेको छ ।
आयोगको आज मंगलबार बसेको बैठकले संघीय सरकार, प्रदेश सरकार वा स्थानीय सरकार अन्तरगत रहेका कुनै पनि कर्मचारी, शिक्षक र प्राध्यापकले कुनै पनि दलको समितिमा बस्न नमिल्ने निर्णय गरेको हो ।
आयोगले सरकारी तलब खाने व्यक्ति कुनै पनि दलको समितिमा रहेको भए उनीहरुको विवरण आयोगमा अद्यावधिक नगर्ने निर्णय गरेको छ । साथै जिल्ला समितिमा रहेका त्यस्ता व्यक्तिको विवरण जिल्ला निर्वाचन कार्यालयले पनि अभिलेख नराख्ने निर्णय गरेको छ ।
हाल सत्तारुढ दल नेपाली कांग्रेस, प्रमुख विपक्षी दल एमाले र अर्को सत्तारुढ दल माओवादी केन्द्र र राष्ट्रिय प्रजातन्त्र पार्टीको महाधिवेशनका लागि जिल्ला तथा प्रदेशहरुमा चुनाव भइरहेका छन् । यी चुनावबाट कर्मचारी, शिक्षक र प्राध्यापकसमेत महाधिवेशन प्रतिनिधि, जिल्ला कार्यसमितिहरुमा निर्वाचित भएको सार्वजनिक भएपछि निर्वाचन आयोगले यस्तो निर्णय गरेको हो ।

काठमाडौं, मंसिर ७ गते
१.यस आयोगमा दर्ता भएका विभिन्न राजनीतिक दलहरूको महाधिवेशनमा सार्वजनिक पदमा वहाल रहेका शिक्षक, कर्मचारी, प्राध्यापकहरू समेत दलका महाधिवेशनमा भाग लिई प्रतिनिधि समेत चयन भएको भनी सञ्चार माध्यममा प्रकाशित प्रसारित समाचार प्रति आयोगको ध्यानाकर्षण भएको छ ।
२.राजनीतिक दल सम्बन्धी ऐन, २०७३ को दफा १४ को उपदफा (२) अनुसार नेपाल सरकार, प्रदेश सरकार वा स्थानीय तहको स्वामित्व वा नियन्त्रणमा रहेको स्वशासित संस्थाको वहालवाला प्राध्यापक, शिक्षक वा कर्मचारीको पदमा वहाल रहेको व्यक्ति राजनीतिक दलको सदस्य हुन नसक्ने व्यवस्था स्पष्ट नै छ । राजनीतिक दलले पनि त्यस्तो सार्वजनिक पदमा वहाल रहेको व्यक्तिलाई दलको सदस्य बनाउन नमिल्ने प्रष्ट व्यवस्था रहेको देखिन्छ ।
३.संघ, प्रदेश तथा स्थानीय तहमा कार्यरत शिक्षक, कर्मचारी प्राध्यापकले राजनीतिमा भाग लिन नहुने व्यवस्था सम्बन्धित कानूनहरूमा समेत उल्लेख भएको छ ।
उल्लेखित पक्षलाई दृष्टिगत गरी आयोगबाट मिति २०७८/८/७ मा देहायानुसार निर्णय भएको व्यहोरा सम्बन्धित सबैको जानकारीको लागि अनुरोध छ ।
(क) राजनीतिक दल सम्बन्धी ऐन,२०७३ को दफा १४ को उपदफा (२) को खण्ड (ग) बमोजिम आयोगमा दर्ता कायम रहेका राजनीतिक दललाई नेपाल सरकार, प्रदेश सरकार वा स्थानीय तहको स्वामित्व वा नियन्त्रणमा रहेका स्वशासित संस्थाको बहालवाला प्राध्यापक, शिक्षक वा कर्मचारीको पदमा बहाल रहेको व्यक्तिलाई राजनीतिक दलको सदस्यता वितरण नगर्न नगराउन तथा सोही ऐनको दफा ५७ को उपदफा (१) बमोजिम राजनीतिक गतिविधि गर्दा कानून बमोजिम गर्नु गराउनु भनी आवश्यक निर्देशन दिने।
(ख) खण्ड (क) बमोजिमको निर्देशन बमोजिम नगरी दलको सदस्यता वितरण र पदाधिकारी चयन गरिएको पाइएमा सम्बन्धित दलका त्यस्ता पदाधिकारीहरूको विवरण आयोगबाट राजनीतिक दल सम्बन्धी ऐन,२०७३ को दफा ५१ बमोजिम अद्यावधिक नहुने व्यहोरा समेत सम्पूर्ण दलहरूलाई जानकारी गराउने।
(ग) आयोगमा दर्ता रहेका राजनीतिक दलबाट दलको प्रदेश समिति तथा जिल्ला समितिमा रहने पदाधिकारी तथा सदस्यको विवरण प्रदेश वा जिल्ला निर्वाचन कार्यालयमा राख्नुपर्ने भएकोले उक्त विवरण प्राप्त हुँदाका बखत त्यस्ता समितिमा खण्ड (क) बमोजिम सार्वजनिक पदमा बहाल रहेका व्यक्ति समावेश भएको पाइएमा त्यस्ता व्यक्तिको नाम पदाधिकारी तथा सदस्यको सूचीबाट हटाउन प्रदेश तथा जिल्ला निर्वाचन कार्यालयले सम्बन्धित दललाई लेखी पठाई आयोगलाई जानकारी दिन निर्देशन दिने।
