काठमाडौँ — सर्वोच्च अदालतको संवैधानिक इजलासले उपप्रधान तथा गृहमन्त्री रवि लामिछानेको नागरिकता कायम नरहेको ठहर गर्दै सांसद् पद खारेज गरिदिएको छ । उनले नेपाल नागरिकता पुन:प्राप्तिको प्रक्रिया पुरा नगरेको भन्दै उनी सांसद बन्न अयोग्य ठहर गरेको हो । योसँगै उनी सांसद् र उपप्रधान तथा गृहमन्त्री हुन अयोग्य भएका छन् ।
कामु प्रधानन्यायाधीश हरिकृष्ण कार्की नेतृत्वमा न्यायाधीशहरू विश्वम्भरप्रसाद श्रेष्ठ, ईश्वर खतिवडा, आनन्दमोहन भट्टराई र अनिल सिन्हा संलग्न संवैधानिक इजलासले शुक्रबार उनीविरुद्ध परेको मुद्दाको फैसला गर्दै नागरिकता कायम नहुनेे ठहर गरेका हुन् ।
गृहमन्त्री रवि लामिछाने गत मंसिर ४ मा सम्पन्न निर्वाचनमा चिवतन–२ बाट प्रतिनिधिसभा सदस्य उम्मेदवार बन्दा उनीसँग नेपाली नागरिकता नभएको भन्दै उनको उम्मेदवारी नै खारेजी गर्न माग गर्दै अधिवक्ताहरू रविराज बसौला र युवराज पौडेलले रिट दायर गरेका थिए । रिटमाथि सुनुवाई गर्दै सर्वोच्च अदालतको संवैधानिक इजलासले पुस ६ मा कारण देखाऊ आदेश जारी गरेको थियो । साथै, अन्तरिम आदेशमार्फत् लामिछानेलाई सांसद्का रूपमा कामकाजमा रोक लगाउन माग गरिएको सन्दर्भमा पुस २२ गते शुक्रबार दुवै पक्षलाई छलफलका लागि बोलाएको थियो ।
त्यसदिन सर्वोच्च अदालतको संवैधानिक इजलासले लामिछानेको मुद्दामा अन्तरिम आदेश दिन अस्वीकार गरेपनि अग्राधिकार दिँदै अन्तिम सुनुवाइका लागि माघ ११ मा पेस गर्न आदेश दिएको थियो । माघ ११ गतेदेखि यस मुद्दाको संवैधानिक इजलासमा भएको बहसपछि शुक्रबार इजलासले नागरिकता अबैध ठहर गर्दै आदेश दिएको हो ।
२०५० सालमा जिल्ला प्रशासन कार्यालय काठमाडौंबाट वंशजको नागरिकता निकालेका लामिछाने रोजगारीको सिलसिलामा अमेरिका पुगेका थिए । त्यसपछि २०७० फागुन ९ मा अमेरिकी नागरिकता र फागुन २१ मा राहदानी प्राप्त गरेका थिए । उनले अमेरिकाको नागरिकता प्राप्त गरेपछि नेपाल नागरिकता ऐनअनुसार उनको नेपाली नागरिकता कायम रहेको थिएन ।
२०७१ जेठ २२ मा उनी अमेरिकी राहदानी प्रयोग गरेर पहिलोपटक गैरपर्यटक (नाता) भिसामा नेपाल आए र पुनः विदेश गएका उनी दोस्रोपटक २०७२ वैशाख २८ मा नेपाल आए । त्यसको १६ औं दिनमा उनले कायम नरहेको पुरानो नेपाली नागरिकता प्रयोग गरेर नेपाली राहदानी बनाए । तर, नेपाली राहदानी बनाएपछि पनि उनी अमेरिकी पासपोर्ट नै प्रयोग गरेर विदेश आउजाउ गरेको अध्यागमनको रेकर्डमा देखिन्छ ।
उनले न्यूज २४ मा काम सुरु गरे । नाता भिसा (वर्क परमिट लिन नमिल्ने प्रकृतिको भिसा) मा नेपाल आएका उनले के कानुनी आधारमा काम गरिरहेका छन् भन्ने प्रश्न उठ्यो । त्यो प्रश्न बढ्दै जाँदा लामिछानेले २०७५ जेठ ४ मा नेपालस्थित अमेरिकी दूतावासमा अमेरिकी नागरिकता र राहदानी त्याग गर्न निवेदन दिए ।
यो प्रक्रिया पूरा नहुँदै उनले अध्यागमन विभागमा आफूले अमेरिकी नागरिकता र राहदानी त्यागेको सूचना २०७५ असार ६ मा दिए । त्यतिन्जेलसम्म उनले नागरिकता त्याग गर्न चाहेको निवेदनलाई अमेरिकाले स्वीकार गरेकै थिएनन् । त्याग गर्ने प्रक्रिया सुरु मात्र गरेको अवस्थामा पनि लामिछानेले अध्यागमन विभागमा आफूले त्याग गरिसकेको भन्ने व्यहोराको लिखित निवेदन दिएका थिए । त्यसको ८ दिनपछि मात्रै अमेरिकाको स्टेट डिपार्टमेन्टले लामिछानेको नागरिकता त्याग गर्ने निवेदनलाई स्वीकार गर्यो । त्यसपछि भने लामिछानेले आफूले अमेरिकी नागरिकता त्याग गरेको विवरण गृह मन्त्रालय मातहतका निकायहरूमा पेस गरेका छैनन् ।
यसैबीचमा २०७९ असार १७ मा लामिछानेले आफूले २०५० सालमै निकालेको नेपाली नागरिकता प्रयोग गरी राष्ट्रिय स्वतन्त्र पार्टी दर्ता गराए । असोज २३ मा उनले प्रतिनिधिसभा निर्वाचनका लागि चितवन-२ बाट उम्मेदवारी दर्ता गराए । अमेरिकी नागरिकता लिइसकेपछि उनको नेपाली नागरिकता कायम नरहेको र पुनः नेपाली नागरिकता प्राप्त नगरी उनी निर्वाचनमा प्रतिस्पर्धा गर्न अयोग्य भएको भन्दै कात्तिक २८ मा निर्वाचन आयोगमा उजुरी पर्यो । आयोगले समयमा निर्णय दिएन । मंसिर ४ मा निर्वाचन र मंसिर ९ मा चितवन–२ को परिणाम घोषणा भयो ।
परिणाम घोषणाअघि उम्मेदवारको अयोग्यतासम्बन्धी निर्णय गर्ने अधिकार आयोगमा रहने तर, परिणाम आइसकेपछि सर्वोच्च अदालतको संवैधानिक इजलासले मात्रै त्यसमा निर्णय गर्ने कानुनी व्यवस्था छ । आयोगले मंसिर १३ मा उक्त उजुरी आफ्नो क्षेत्राधिकारमा नपर्ने भन्दै तामेलीमा राख्ने निर्णय गर्यो । त्यसपछि अधिवक्ताहरू बसौला र पौडेले रिट लिएर मंसिर २८ मा सर्वोच्च अदालत पुगे । त्यही निवेदनमाथि बुधबारबाट संवैधानिक इजलासमा पूर्ण सुनुवाइ सुरु भएको हो ।
नागरिकता ऐन (दफा १०.१) ले कुनै व्यक्तिले विदेशको नागरिकता प्राप्त गरेपछि उसको नेपाली नागरिकता कायम नरहने व्यवस्था गरेको छ । त्यस्तै सोही ऐन (दफा १०.२) मा नेपाली नागरिकता त्याग गर्ने सूचना दिनुपर्ने र त्यसरी त्याग सूचना दर्ता भएको मितिदेखि सम्बन्धित व्यक्तिको नेपाली नागरिकता कायम नरहने व्यवस्था छ । साथै ऐनको दफा ११ मा ‘कुनै नेपाली नागरिकले विदेशी मुलुकको नागरिकता प्राप्त गरेपछि पुनः नेपालमा आई बसोबास गरेको र विदेशी मुलुकको नागरिकता त्यागेको निस्सा तोकिएको अधिकारीलाई दिएमा त्यस्तो निस्सा दर्ता भएको मितिदेखि निजको नेपाली नागरिकता पुनः कायम हुने’ व्यवस्था छ । लामिछानेका कानुन व्यवसायीले २०७५ असार ६ अध्यागमन विभागमा लामिछानेले आफूले अमेरिकी नागरिकता त्यागेको भन्दै दिएको जानकारीलाई नै ‘पुनः नेपाली नागरिकता प्राप्त गर्नका लागि विदेशी मुलुकको नागरिकता त्यागेको निस्सा तोकिएको अधिकारीलाई दिएको’ अर्थ्याएका थिए ।
तर, रिट निवेदकहरूले भने एक पटक नागरिकता कायम नभएपछि पुनः नेपाली नागरिकता प्राप्त गर्नका लागि नागरिकता नियमावलीको नियम ११ को प्रक्रिया पूरा हुनुपर्ने र लामिछानेले त्यस्तो प्रक्रिया पूरा नगरेको दाबी गरेका थिए। जसमा ‘नेपालको नागरिकता त्यागी विदेश गएको कुनै व्यक्तिले पुनः नेपाली नागरिकता प्राप्त गर्न चाहेमा विदेशको नागरिकता त्यागेको निस्सासहित निजलाई पहिले नागरिकताको प्रमाणपत्र प्रदान गर्ने मन्त्रालय वा सम्बन्धित जिल्ला प्रशासन कार्यालयसमक्ष अनुसूची–११ बमोजिमको ढाँचामा निवेदन दिनुपर्ने,’ व्यवस्था छ । लामिछानेले यो प्रक्रिया पूरा नगरेका कारण उनी उम्मेदवार बन्न अयोग्य रहेको दाबी रिट निवेदकहरूको थियो।इ-कान्तिपुरबाट साभार
